1. About these terms
These Terms of Service (“Terms”) govern your use of the Kinsoft AI Calling platform (“Service”), operated by Kinsoft (ABN 81 640 437 154), of New South Wales, Australia (“we”, “us”). By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of a business, you warrant you are authorised to bind that business.
2. The Service
The Service provides AI-assisted outbound calling and inbound receptionist capability. Calls are placed using your own SIP trunk or numbers you configure. AI processing (speech recognition, language models and voice synthesis) and data storage are performed on infrastructure located in Australia.
3. Your responsibilities
You are solely responsible for the legality of every call placed through your account, including compliance with the Spam Act 2003 (Cth), the Do Not Call Register Act 2006 (Cth) and the Telemarketing and Research Calls Industry Standard, the Privacy Act 1988 (Cth) and the Australian Privacy Principles, and any overseas laws that apply to calls you place outside Australia (for example the TCPA in the United States or GDPR/PECR in Europe). You must: (a) hold any consents required for your calls; (b) wash your calling lists against the Do Not Call Register where required; (c) honour opt-out requests promptly; (d) call only within lawful calling hours; and (e) not disable or circumvent the AI disclosure included in call openings. Calls made by the Service identify themselves as AI-assisted; you must not configure scripts to conceal this.
4. Prohibited use
You must not use the Service for scams, deceptive or misleading conduct, harassment, emergency services calls, political robocalling in breach of applicable law, or calls to persons you know to be vulnerable. We may suspend accounts we reasonably believe are being used unlawfully, and we maintain automated safeguards (including call caps and kill switches) that may pause calling while suspected misuse is reviewed.
5. Fees and billing
Pricing is a monthly base fee plus usage billed per hour of dial time, as displayed on our pricing page at the time of purchase. Usage is metered and billed through Stripe. Fees are in Australian dollars and include GST where applicable. We may change pricing with at least 30 days’ notice; changes take effect at your next billing cycle. Unpaid accounts may have calling paused.
6. Your data
You retain ownership of your lead lists, scripts, recordings and call data. You grant us a licence to process this data to operate the Service. Our handling of personal information is described in our Privacy Policy and, where you are a data controller, the Data Processing Agreement.
7. Availability and support
We aim for high availability but the Service is provided without uptime guarantees unless separately agreed in writing. We may perform maintenance with reasonable notice where practicable.
8. Liability
Nothing in these Terms excludes rights under the Australian Consumer Law that cannot be excluded. Subject to that: (a) the Service is provided “as is”; (b) to the maximum extent permitted by law our total liability arising out of the Service in any 12-month period is limited to the fees you paid in that period; and (c) we are not liable for indirect or consequential loss, or for penalties arising from your breach of telemarketing or privacy laws.
9. Termination
You may cancel at any time from your billing page; cancellation takes effect at the end of the current billing period. We may terminate for material breach, including breach of clause 3 or 4. On termination we will delete or return your data in accordance with the DPA.
10. General
These Terms are governed by the laws of Australia. We may update these Terms from time to time; material changes will be notified to your account email at least 14 days before taking effect.
